Update on technip prosecution
The Commonwealth Director of Public Prosecutions (CDPP) has successfully appealed a decision by the Magistrates Court of Western Australia in relation to Technip Australia Pty Ltd.
Following an investigation by NOPSEMA a prosecution was commenced by the CDPP and in April 2019, Technip was acquitted of a charge of breaching the Offshore Petroleum and Greenhouse Gas Storage Act 2016 during saturation diving operations on the Chevron Australia Pty Ltd operated Wheatstone platform.
The charge related to the performance of work at a facility in Commonwealth waters, in a manner that was contrary to the safety case in force for that facility.
The CDPP sought leave to appeal the decision which was upheld by the Supreme Court of Western Australia.
The matter will now be remitted to the Magistrates Court of Western Australia for rehearing.
